Copyright Complaints

Service Llama LLC (“ServiceLlama,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to our designated agent as described below.

Filing a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our website, application, or service (the “Service”), please send a written notification to our designated copyright agent. Under the DMCA, your notification must include the following:

  1. Identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
  2. Identification of the material that you claim is infringing and that you request be removed or access to which be disabled, with enough detail so that we can locate the material. Please provide the specific URL(s) or a detailed description of where the material can be found within the Service.
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (full legal name is acceptable as an electronic signature).

Important: Please use the subject line “DMCA Notice” when submitting your notification by email so that we can process it promptly.

Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated copyright agent. Your counter-notification must include the following:

  1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your full legal name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if you are outside of the United States, the Southern District of New York), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Your physical or electronic signature (full legal name is acceptable as an electronic signature).

If we receive a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If the original notifying party does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days of receiving the counter-notification, we may restore the removed material in our sole discretion.

Repeat Infringers

In accordance with the DMCA and other applicable law, ServiceLlama has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. If you are not sure whether material available online infringes your copyright, we suggest that you contact an attorney before filing a DMCA notification or counter-notification.

Other Intellectual Property Complaints

If you believe that your intellectual property rights have been violated in a manner other than copyright infringement (for example, trademark infringement), please contact us at legal@servicellama.com with a detailed description of the alleged violation, and we will review your complaint.
